These Terms and Conditions ("Terms") govern your use of Tempist Fire Advisor ("Tempist," "Service," "we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree to these Terms, do not use the Service.
1. Service Description
Tempist Fire Advisor is an advisory notification service that provides information about outdoor wood boiler operation based on telemetry data from connected monitoring equipment.
Advisory Information Only: Tempist provides advisory information and notifications intended to assist users in monitoring their outdoor wood boilers. Tempist does not control, operate, or make decisions for your boiler equipment. All information provided by Tempist is advisory in nature and should not be relied upon as the sole basis for any action or inaction.
2. User Responsibility
You acknowledge and agree that:
- You remain solely responsible for the operation, maintenance, and safety of your outdoor wood boiler and related equipment.
- You are responsible for regularly inspecting and monitoring your boiler, regardless of notifications received from Tempist.
- Advisory notifications from Tempist do not replace proper boiler operation practices, manufacturer guidelines, or local regulations.
- You are responsible for ensuring that your boiler monitoring equipment is properly installed and functioning.
- You are responsible for maintaining accurate contact information in your account.
3. No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- Notifications will be delivered successfully in all circumstances
- Predictions or advisories will be accurate or complete
- The Service will meet your specific requirements
- Any defects in the Service will be corrected
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TEMPIST, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Property damage
- Loss of use
- Loss of data
- Loss of profits
- Personal injury
- Equipment damage
- Freezing or water damage
- Fire damage
ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
5. No Emergency Service
Tempist is not an emergency service. Do not rely on Tempist for emergency notifications or time-critical alerts. Tempist notifications may be delayed, undelivered, or inaccurate. In case of emergency, contact appropriate emergency services directly.
6. SMS and MMS Terms
If you opt in to receive SMS or MMS notifications from Tempist:
- Message Frequency: Message frequency varies based on your boiler's activity and your notification preferences.
- Message and Data Rates: Message and data rates may apply. You are responsible for any charges from your mobile carrier.
- Opt-Out: You may opt out at any time by replying STOP to any message from Tempist.
- Help: For assistance, reply HELP to any message from Tempist, or contact support@tempist.net.
- Supported Carriers: Carriers are not liable for delayed or undelivered messages.
7. Account Registration
To use certain features of the Service, you may need to create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update your account information if it changes
- Accept responsibility for all activities that occur under your account
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service
- Reverse engineer, decompile, or disassemble any portion of the Service
- Use the Service in a manner that could damage or overburden our systems
9. Intellectual Property
The Service, including all content, features, and functionality, is owned by Tempist and is protected by copyright, trademark, and other intellectual property laws.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us.
11. Changes to Terms
We may modify these Terms at any time. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
13. Dispute Resolution
Any dispute arising from these Terms shall be resolved through binding arbitration in Erie, Pennsylvania, in accordance with the rules of the American Arbitration Association.

What You Will Receive
By enabling SMS notifications, you agree to receive automated text messages from Tempist Fire Advisor. These messages are utility notifications related to your boiler's operation and may include:
- Fire Status Alerts: Notifications when your fire needs attention, such as when fuel may need to be added.
- Fire-Out Predictions: Advisory alerts estimating when your fire may go out if not attended to.
- Safety Advisories: Notifications about potential concerns, such as freezing risk during cold weather.
- Service Communications: Important information about your Tempist account or the service itself.
Message Frequency
Message frequency varies based on your boiler's activity and your notification preferences.
- During active heating periods, you may receive several messages per day.
- During warmer months or periods of boiler inactivity, you may receive few or no messages.
- Typical usage is a few messages per day or less during heating season.
No Marketing Messages
Tempist SMS notifications are utility messages only. We do not send marketing, promotional, or advertising messages via SMS. Your phone number will not be shared with third parties for marketing purposes.
Message and Data Rates
Standard message and data rates from your mobile carrier may apply. Tempist does not charge for SMS notifications, but your carrier may charge you for receiving text messages based on your mobile plan.
How to Opt Out
You can opt out of SMS notifications at any time.
- Reply
STOP to any text message from Tempist to unsubscribe from all SMS notifications.
- You will receive a confirmation message and will not receive further SMS notifications unless you opt in again.

Important Information
- Advisory Only: Tempist notifications are advisory information only. They do not control your boiler and should not be relied upon as the sole means of monitoring your equipment.

Return Policy

Thank you for purchasing from Tempist. We want you to be completely satisfied with your purchase. Please review our return policy below.
1. Return Eligibility
To be eligible for a return, your item must be:
- Unused and in the same condition that you received it
- In the original packaging
- Returned within 30 days of the purchase date
- Accompanied by a receipt or proof of purchase
2. Non-Returnable Items
The following items cannot be returned:
- Items that have been used, installed, or show signs of wear
- Items damaged due to misuse or negligence
- Software subscriptions or digital services after activation
- Items purchased more than 30 days ago
3. Return Process
To initiate a return:
- Contact us at support@tempist.net with your order number
- We will provide you with a Return Merchandise Authorization (RMA) number
- Pack the item securely in its original packaging
- Ship the item to the address provided with the RMA number clearly marked
4. Refunds
Once your return is received and inspected:
- We will notify you of the approval or rejection of your refund
- Approved refunds will be processed within 5-10 business days
- Refunds will be credited to the original payment method
- Original shipping costs are non-refundable unless the return is due to our error
5. Exchanges
If you received a defective or damaged item, we will exchange it for the same item at no additional cost. Contact us within 7 days of receiving your order to report any defects.
6. Shipping Costs

- We recommend using a trackable shipping service
- Tempist is not responsible for items lost or damaged during return shipping
7. Warranty
Tempist devices come with a 1-year limited warranty covering manufacturing defects. This warranty does not cover:
- Damage from misuse, accidents, or unauthorized modifications
- Normal wear and tear
- Damage from environmental conditions outside specified operating ranges
